Refund Policy
- Once your plot is purchased it cannot be refunded unless there is a problem within the transaction.
- If for any reason there is an error on the amount of money paid we will then refund the difference.
- Once all your documents have been received, signed and sent by us to Land Registry there is no refund as this plot of land and tree is then legally owned by you.

Terms of Sale
Explanation and terms of sale of 6m x 6m square plots of land with a tree on each at East Park Farm, Newchapel, Lingfield, RH7 6HS
Owner: Mr Michael Steven Vaughan
- The proposal is that the Seller, Mr Vaughan, who owns the site, sells the 6m x 6m square plots with a tree as identified on the plan to the Buyer.
- Mr Vaughan expects there to be a heavy demand for the plots. They will, therefore, be sold as allocated by him and the Buyer will not be able to choose a particular plot number.
- The individual plots will not be fenced. Mr Vaughan is under no obligation to prove the exact boundaries of the property.
- During the first planting season after completion of your purchase a tree will be planted on the plot and it will have a number tag attached to it identifying the plot number. The tree to be planted will be of a broad leaf variety.
- The species of tree planted on the land will be in the sole discretion of the Seller, Mr Vaughan. Trees will only be planted during the planting season.
- Access at all times will need to be given to the Seller, Mr Vaughan, or his contractors during the planting season for the purpose of planting the tree and at any other time for mowing the grass and general maintenance of the plot (if so required).
- If the tree dies or needs to be replaced during the first 10 years after planting Mr Vaughan will replace it once, but thereafter it will be up to the Buyer to arrange this.
- The price for each plot of land (the Property) will be £299.00 which includes the Land Registry fee and the tree and the tag attached to the tree.
- The price of £299 is exclusive of VAT. Mr Vaughan is not currently registered for VAT and no VAT will be charged on the price.
- All buyers will be required to give their full names and addresses. The buyers must all be 18 years or older and of full capacity. Each plot may be registered in the names of no more than four individuals.
- Mr Vaughan wishes to make the transaction as simple as possible and it is not intended there should be a contract for the sale and purchase of the Property. If the Buyer wishes to obtain the advice of his or her solicitors the Buyer is, of course, perfectly free to do so but must bear the costs of that.
- The title to the property is freehold. The Buyer will have no right of light or air over any adjoining land.
- The Transfer Deed (the TP1), which transfers the title in the Property, sets out the matters which benefit the Property, the rights over the Property, the rights retained out of the Property and the restrictions regarding the use of the Property. These are intended to be for the mutual benefit of all buyers.
- The TP1 and the Register Entries of Mr Vaughan's title are available for viewing in the Legal Documents section of this website and all buyers are advised to read this section carefully before proceeding.
- The presence of the TP1 and AP1 on the website does not mean in any way that the Land Registry endorses or supports the scheme or confirms that the content of the TP1 or AP1 has been approved. It is the intention of Mr Vaughan that all the TP1 and AP1 forms are in identical form save as to Buyer's details and plot numbers.
- The Property is sold subject to all that is noted on the Property Register and entered in the Charges Register of Mr Vaughan's title, which are available for viewing and set out in the Register Entries.
- The Property is also sold subject to all encumbrances which are discoverable by inspection of the Property, all those which Mr Vaughan does not and could not know about, all entries made before completion in any public Register and all public requirements.
- The Property is sold subject to any disclosable interests, although Mr Vaughan, is not aware of any.
- Mr Vaughan is under no obligation to the Buyer to insure the Property and it will be transferred to the Buyer in the physical state existing at the time of completion of the TP1.
- If the Buyer is willing to proceed on the basis of the matters set out and referred to in the TP1 the Buyer will download and print the TP1. The Buyer should insert his name at Box 7 and address at Box 8. The Buyer will write his name at Box 14 and sign the TP1. The Buyer's signature must be witnessed by an independent person, who must be at least 18 years of age and must not be related or connected to the purchase, who should also sign the form and write in their full name, address and occupation. The TP1 should be left undated.
- The Buyer will then download and print the AP1, which is the form applying to the Land Registry to register the transfer. The Buyer should insert his name and address at Boxes 7 and 9 of the AP1. This form must be signed by the Buyer on the third page in Box 14, but left undated. The date will be inserted after completion.
- Following receipt by Mr Vaughan of the AP1 and TP1 signed by the Buyer, the TP1 will be signed by Mr Vaughan, who will complete the appropriate sections of a Stamp Duty Land Transaction Return Form (SDLT1) and post the SDLT1 to the Buyer so the Buyer may insert the Buyer's relevant details and sign the form. The Buyer will then return the SDLT1 to Mr Vaughan.
- On receipt of the completed and signed SDLT1 Mr Vaughan will date the TP1 and completion will be deemed to take place. The relevant forms will then be processed and sent by Mr Vaughan to the Land Registry to register the Property with Separate Title (AP1) Registered in your name.
- The Land Registry will be instructed to send the evidence of the registered title, being the Title Information Document, direct to the Buyer.
